Can you picture yourself purchasing land on the tropical beaches of Panglao Island in the Philippines? The soft sounds of the waves are calling you. If you are unable to make the trip back and sign the papers, you can assign a Special Power of Attorney to close the deal on your behalf.
You will need to present certain documents. Authenticated paperwork such as your federal tax forms, a copy of your passport, or even a birth certificate may be required to do business in the Philippines. And you will need to obtain an apostille each of these documents.
What is an Apostille?
An apostille verifies the authenticity of a document. All countries that are members of the Hague Convention of 1961 accept an apostille as a valid form of the document’s legitimacy.
The Philippines joined the Hague Convention in 2019 – meaning all documents can receive an apostille instead of having each paper receive legalization from the Embassy or Consulate. Documents no longer require the red ribbon or red seal from the Philippines Embassy or Consulate.
What is a Special Power of Attorney?
A Power of Attorney gives an assigned person the authority to make legal decisions on your behalf. A Special Power of Attorney lets that person enter in legal deals only under specific and clearly defined circumstances… such as purchasing a particular piece of land.
Once you have a proper Special Power of Attorney written, the next step is to have it notarized and apostilled.
Apostille the Special Power of Attorney
While you are at the lawyer’s office to obtain the Special Power of Attorney, have them notarize the document.
Since this is a federal document, once notarized, you will send the papers to the Secretary of State in Washington, DC to obtain the apostille. This can include governmental red tape, steps that you never knew existed, and waiting for someone to answer your questions… someday.
Or the easier way is to work with One Source Process.
